DELIVERY COSTS

The buyer bears the delivery cost within Croatia. The delivery price (up to 3 kg) is fixed, regardless of the destination within Croatia, including islands. (list of islands and delivery schedules attached) For all island destinations not on the attached list/map, please contact DELMERION. The delivery cost is €5.57 per shipment (VAT included). Delivery is free for orders over €50.00.

DESCRIPTION OF DELIVERY METHOD AND TIMEFRAME

Once your order has been authorized, the products will be delivered within 5 working days.

UNILATERAL CONTRACT TERMINATION

You can unilaterally terminate the contract within 14 days without giving a reason. To exercise the right to unilateral termination, you must inform us of your decision before the deadline by sending an unambiguous statement by post, fax, or email, including your name, address, phone number, fax number, or email address. You may also use the attached contract termination form (downloadable). You can fill out and send the form electronically on our website. We will confirm receipt without delay by email.

The 14-day period starts from the day the consumer or a third party (other than the carrier) designated by the consumer takes possession of the goods. If multiple items were ordered to be delivered separately, the period starts from the day possession is taken of the last item or shipment. If regular delivery over a period is agreed, the period starts from the day possession is taken of the first item or shipment.

If you terminate the contract, we will refund all payments received from you, including delivery costs, without delay and no later than 14 days from the day we received your termination notice, except when you chose a more expensive delivery method. The refund will be made using the same payment method you used, or to your bank account if you paid upon delivery. If you agree to another refund method, you will not incur any additional costs.

We may withhold the refund until we receive the goods back or proof that they have been returned.

You must return the goods without delay, no later than 14 days from notifying DELMERION of your decision to terminate. You meet the deadline if you send or hand over the goods before the 14-day period expires. You bear the direct costs of returning the goods.

CONSUMER LIABILITY FOR DIMINISHED VALUE

You are responsible for any diminished value of the goods resulting from handling beyond what is necessary to determine the nature, characteristics, and functioning of the goods.

EXCLUSIONS FROM THE RIGHT OF TERMINATION

The right of unilateral termination does not apply if:

the price depends on market fluctuations beyond the seller’s control,
the goods are made to the consumer's specifications or clearly personalized,
the goods are perishable or have a short shelf life,
sealed goods unsuitable for return for health or hygiene reasons if unsealed after delivery,
goods that, after delivery, are inseparably mixed with other items,
digital content not supplied on a physical medium if performance began with the consumer’s explicit consent and acknowledgment of losing the right of termination.

COMPLAINTS

According to the Consumer Protection Act, the user has the right to submit a written complaint at DELMERION’s premises, by post, or by email. DELMERION will confirm receipt in writing without delay for complaints delivered in person and will respond within 15 days as required by law.

CONSUMER DISPUTE RESOLUTION

We inform you that we resolve all disputes amicably and that you have the right to use out-of-court mechanisms by submitting a complaint to the Court of Honor of the Croatian Chamber of Commerce and/or a mediation proposal to the Mediation Center at the Croatian Chamber of Commerce.

ONLINE DISPUTE RESOLUTION

We inform you of the possibility to resolve consumer complaints through online dispute resolution under Regulation 2006/2004, Directive 2009/22/EC, and Directive 2013/11/EU on alternative dispute resolution.

LIABILITY FOR MATERIAL DEFECTS

In accordance with the Civil Obligations Act (Articles 400–422), we are liable for material defects that existed at the time the risk passed to the buyer or that appeared later if caused by a pre-existing reason.

USE AND PROTECTION OF PERSONAL DATA

At DELMERION, we value your privacy and keep your personal data strictly confidential. All our online activities comply with European regulations (Regulation (EU) 2016/697, GDPR) and Croatian national laws. The Privacy Policy (link) governs the use of information collected when you visit DELMERION’s website, register, make a purchase, or contact customer service. As a registered user, you receive an account (User Account). DELMERION advises you not to disclose your account details. You are solely responsible for maintaining the confidentiality and security of your account and all activities on it. You must inform DELMERION immediately of any misuse. DELMERION is not liable for damages arising from unauthorized account use. The Privacy Policy is an integral part of these Terms and can be read here.

COPYRIGHT AND INTELLECTUAL PROPERTY

All content on https://neoviderm.hr is protected under the Copyright and Related Rights Act. Copyrights covering text, images, databases, graphics, sounds, software, and names (including the domain) belong to DELMERION. Any use beyond what is provided by these General Terms, including copying, transcription, or distribution without authorization, is illegal and subject to legal action. DELMERION is not liable for copyright violations by advertisers.

EXCLUSION FROM USE, DAMAGES

DELMERION may exclude any user who violates these General Terms, disrupts the website, infringes on user rights, misuses published data, or uses https://neoviderm.hr unlawfully. DELMERION may seek damages and lost profits and will take legal measures as necessary.

DISCLAIMER

DELMERION is not liable for:

the authority of the other party to conclude contracts,
constant availability and functionality of the website,
data loss during internet transmission,
third-party use of the website,
presentation errors possibly violating copyrights,
direct or indirect damage from website use or linked sites,
damage or lost profit due to service interruption,
third-party content accessible through links.

CHANGES

DELMERION BEAUTY d.o.o. may change these Terms at any time and will inform customers via the website. Customers must read and agree to the current Terms during registration and before each subsequent purchase. DELMERION is not responsible if the customer fails to do so.
